Terms & Conditions

These terms are the agreement between you and AKQX QuantumTrade. Please read them before you create an account, connect a broker or exchange, or let the platform place any order for you.

Effective: 14 October 2026Last updated: 14 October 2026Version 1.4

1. Plain-language summary

The short version
  • AKQX QuantumTrade is software: market data, order-flow analytics, backtesting, strategy tools and automated order execution through your own broker or exchange account.
  • We do not give buy/sell recommendations, investment advice or research reports. You decide everything and you carry all trading risk.
  • AKQX is not registered with SEBI as an Investment Adviser or Research Analyst.
  • We are not a broker, exchange or custodian and never hold your trading money. Your funds stay with your broker or exchange.
  • Backtest and paper-trading results are simulated and do not predict real results. You can lose some or all of your capital, and with leverage even more than you expected.
  • Closing your account does not close positions already open at your broker.

This summary is only a convenience. The numbered sections below are the binding terms.

2. Agreement and who we are

These Terms & Conditions (“Terms”) govern your use of the website https://akqxquantum.tech, the AKQX QuantumTrade web application, and every related feature, API and notification channel (together, the “Platform”).

The Platform is operated by Akash Paikra, operating as AKQX QuantumTrade, an individual founder based in India (“AKQX”, “we”, “us”). No company has been incorporated yet (company details: coming soon). When the business is incorporated, these Terms will transfer to the new entity and we will tell you.

By creating an account, ticking the acceptance box at sign-up, connecting a broker or exchange, or otherwise using the Platform, you confirm that you have read and agree to these Terms and to our Privacy Policy, Refund Policy and Disclaimer. If you do not agree, do not use the Platform.

This is an electronic record under the Information Technology Act, 2000 and the rules made under it. It is generated by a computer system and does not need a physical or digital signature.

3. What AKQX is, and is not

AKQX QuantumTrade is an algorithmic-trading software platform for Indian markets and crypto futures (including Delta Exchange India). It provides real-time market data, order-flow analytics (such as footprint, cumulative delta and CVD), backtesting, strategy-building tools, paper trading, and automated order execution through API connections to brokers and exchanges that you own and connect. Other markets may be offered for chart analysis only.

AKQX is not:

  • a SEBI-registered Investment Adviser or Research Analyst. We do not give investment advice, buy/sell/hold recommendations, price targets or research reports, and we do not hold ourselves out as doing so;
  • a stock broker, trading member, exchange, clearing corporation, depository, or crypto exchange;
  • a bank, wallet, payment institution or custodian. We do not receive, hold or transmit your trading funds;
  • a portfolio manager, fund or pooled-investment scheme.

Orders you place are executed by your broker or exchange under their terms, fees, margin rules and regulatory status. They, not AKQX, hold your funds and positions.

4. Eligibility

To use the Platform you must:

  • be at least 18 years old and capable of entering a binding contract under the Indian Contract Act, 1872;
  • be an Indian resident. To trade on a broker or exchange you must complete that provider's own KYC and hold an account with it in your own name. We rely on the provider's KYC and do not carry out KYC on your behalf;
  • use the Platform for yourself and not on behalf of anyone else unless we have agreed in writing;
  • give accurate, current and complete information;
  • not be barred by any law from trading the relevant instruments.

You are responsible for knowing whether trading a given product (for example crypto assets, leveraged derivatives, or any instrument that needs specific eligibility) is lawful for you, and for obeying that law. We may refuse or restrict access in any region at any time.

5. Your account and security

  • One person, one account. Do not share your account or let anyone else sign in as you.
  • Keep credentials secret. You are responsible for your password, one-time codes, authenticator app, backup codes and every action taken through your account. We strongly recommend turning on two-factor authentication.
  • Tell us quickly. If you suspect unauthorised access, change your password, review your signed-in devices, revoke your broker API keys, and e-mail founder@akqxquantum.tech.
  • Protective controls. To protect accounts we may lock sign-in after repeated failed attempts, expire sessions or require re-verification.
  • Sign-in with Google. If you use Google to sign in, Google's terms apply to that connection.

6. The services

ServiceWhat it is
PreviewLimited access to the Advanced Chart without an account.
Free accountPaper trading with virtual capital, backtests on historical data, saved layouts, drawings and alerts, and the ability to connect your own broker or exchange.
Automated executionAn optional layer that sends orders to a broker or exchange account you have connected and authorised. Available through supported exchange accounts you connect. We do not offer real-money execution for Indian equities.
Paid plansPlanned, not yet available. See “Subscriptions, payments and auto-renewal”.

Features, limits and supported markets or brokers can change. Anything marked preview, beta or “coming soon” may be incomplete or withdrawn without notice. Education and community content we publish (including on social media) is described in the Disclaimer.

7. No investment advice

Important

AKQX is not a SEBI-registered Investment Adviser or Research Analyst. Nothing on the Platform is investment, financial, legal or tax advice, a recommendation, a research report, or an offer or solicitation to buy or sell any instrument.

Charts, indicators, order-flow views, alerts, scores, rankings, “verified” labels, backtest statistics, explanatory text and example data are informational tools and the output of mathematical rules. They are not a view on what you should do and are not tailored to your goals, finances or risk tolerance.

You decide which instruments to trade, which strategies to run, and with what capital and risk settings. You alone are responsible for the results. Before trading, consider speaking to a SEBI-registered investment adviser; you can check registration on the SEBI website.

8. Backtests, paper trading and rankings

Backtests and paper-trading results are hypothetical. They run rules against historical or live market data with assumed costs, and they have inherent limits:

  • They are prepared with hindsight and may not reflect real fills: queue position, partial fills, slippage, latency, spreads, funding, liquidity, halts and circuit limits.
  • Cost models (fees, slippage, leverage, margin) are approximations and will differ from your broker's real charges, taxes and rounding.
  • Strategies can be over-fitted to the past. A strategy that scored well historically can lose money going forward.
  • Paper trading has no real money at stake and cannot reproduce the pressure of real trading.

Past or simulated performance does not guarantee future results, and we do not promise or imply any return. A ranking, score or “verified” label only describes how an algorithm performed on specific data under specific assumptions. It is not a recommendation.

9. Your broker, exchange and API keys

You authorise, you control

Automated execution is off unless you switch it on. When you connect a broker or exchange account and enable real trading or deploy an algorithm to it, you instruct and authorise AKQX to place, modify and cancel orders on that account according to the strategy and risk settings you chose. You can pause or disconnect at any time, but that cannot undo an order already sent.

Your API keys

  • You are responsible for the API keys and tokens you create. Give them the narrowest permissions that work: enable trading only and never enable withdrawals. Restrict by IP address if your broker supports it, and revoke keys you no longer want us to use.
  • We store credentials in encrypted form and use them only to provide the features you enabled (see the Privacy Policy). No system is perfectly secure.
  • You must follow your broker's and exchange's terms and API rules. If a broker suspends your account or key, that is between you and the broker.

Indian securities and SEBI's algo-trading rules

Trading Indian securities and derivatives through a broker API is subject to SEBI's framework for retail algorithmic trading as applied by the exchanges and your broker. Your broker may require, among other things, registration of the API, a fixed IP address, order tagging, or approval of the algorithm, and it may block or limit API orders. We do not promise that any feature, strategy or integration is approved by, or will keep working with, any exchange or broker. You are responsible for meeting your broker's requirements.

Crypto

Crypto assets are not regulated as securities in India and carry high risk. Exchanges serving Indian users have their own registration and KYC duties. You are responsible for your own tax and compliance (see “Subscriptions, payments and auto-renewal” and the Disclaimer).

Reconciliation and records

We compare the positions and fills we record with your broker's records and try to correct differences. Your broker's records are the source of truth. Profit-and-loss figures shown on the Platform are estimates and may differ from your broker's statements. Use your broker's statements for accounting and tax.

10. Automated execution and alerts

Automation can lose money quickly

An automated strategy keeps acting on its rules until you stop it or a configured guard halts it. A faulty strategy, setting or market condition can repeat losses fast. Monitor your deployments and keep the ability to close positions directly with your broker.

Without limitation, the following can cause losses or unexpected results, and none is within our control:

  • Latency and delays between a signal, our servers, the internet and your broker or exchange;
  • Outages and API failures: of our Platform, our hosting, the data feed, or your broker or exchange, including rate limits, changed or withdrawn APIs, expired tokens and rejected orders;
  • Slippage, partial fills, wide spreads, liquidity gaps, price gaps beyond a stop-loss, funding, margin calls and forced liquidation;
  • Data errors, stale or out-of-order prices, and clock differences;
  • Software bugs in the Platform or in a strategy.

Safety features such as leverage caps, fee-aware sizing, minimum stop distance, circuit breakers, broker-side stop-loss and take-profit, position reconciliation and alerts reduce certain risks but do not remove them, and may fail. Alerts (in-app, e-mail, Telegram or others) are best-effort, can be delayed or fail, and must not be your only protection.

Before you deploy any algorithm, you must review its logic, markets, capital and risk settings. You confirm this when you accept the algorithm-deployment risk notice.

11. Market data and analytics

Prices, order-book depth, trades and candles come from third-party exchanges, brokers and data vendors. They may be delayed, incomplete, revised, interrupted or wrong, and different sources can show different prices. Derived analytics, such as footprint, cumulative delta, CVD, liquidity maps and detections of large or hidden orders, are statistical inferences from public data. They are not facts about any trader's intent and not predictions. Data is for your personal use only: you may not redistribute, resell, scrape or bulk-export it, and the data vendor's own terms may add limits. AKQX does not sell market data. You have two options. Option 1, data AKQX provides: where the Platform shows market data, it is free to use for your own information. We have asked data providers for written permission to offer it broadly; approval is pending (coming soon), and until then availability may be limited and can change or end without notice. Option 2, your own data: you may work with your own data, live or historical, by connecting your own exchange or broker account with your own API keys (available today where supported) or by importing your own files (coming soon). Whichever you use, it is for your own use only, you must have the right to use that data and comply with each provider's terms, and you may not copy, redistribute or resell it. We may turn a data source on or off, provider by provider, at any time.

12. AI assistant, and no AI trading

AKQX is not an “AI trading” service. We do not offer an AI that decides what you should buy or sell, and no AI places trades for you. Orders are placed only by the rules (strategies) that you create and switch on.

Where we offer an AI-assisted Strategy Builder, it helps you draft strategy rules from a description you write, using an AI provider we work with or, if you choose, a provider whose API key you connect yourself. AI is a drafting tool only. Its output can be wrong, incomplete or unsuitable, it is not advice or a recommendation, and you must review, backtest and understand any strategy before you use it. You alone are responsible for strategies you save or run. What you type is processed by the AI provider (see the Privacy Policy); do not enter passwords, exchange or broker credentials, or personal information. An AI key you connect remains yours: use it in line with that provider's terms, and any usage cost is between you and the provider.

13. Subscriptions, payments and auto-renewal

Current status

The Platform is currently free. No payment is taken today. The rules below apply only when we introduce paid plans.

  • Clear price before you pay. Before any charge, we will show the plan, price, billing period, what is included, whether tax is included, and the renewal terms. A paid plan starts only when you actively choose it and confirm payment. We will not charge you retroactively for anything that was free.
  • Payments. Payments are processed by an RBI-authorised payment gateway (coming soon). We do not see or store your full card, UPI or bank details.
  • Auto-renewal. If a plan renews automatically, we will say so before you subscribe and obtain your consent through the gateway's authenticated e-mandate or similar process, as RBI rules require. Before each automatic debit you will receive a notice at least 24 hours in advance showing the amount and date, as the rules provide. Some debits may need your extra authentication.
  • Cancel easily. You can cancel a subscription at any time from your account settings or by e-mailing us. Cancelling stops future renewals; access continues to the end of the period you have paid for. We do not make cancellation harder than sign-up.
  • Refunds. See the Refund Policy. Trading losses are never refundable.
  • Price changes. We may change prices for future periods. We will tell you in advance and the change will not apply until your next renewal, when you can cancel.
  • Tax. Prices may be subject to GST where applicable (coming soon). You are solely responsible for tax on your own trading and income, including any income tax, TDS and tax on virtual digital assets. We give no tax advice and Platform figures are not tax statements.
  • Third-party costs. Brokerage, exchange fees, funding, spread and data fees charged by your broker or exchange are between you and them.

14. Strategies you build

AKQX does not sell, recommend or hand out trading strategies. You design your own strategy and algorithm, and you decide whether and when to run it. What we provide is the toolbox: a strategy builder, example templates, a backtesting engine, paper trading, risk settings, and the execution connection to your broker or exchange.

  • Yours, and your risk. The strategies you build, their rules, settings, capital and risk limits are your own. You own them (see “Intellectual property”), and you are fully responsible for what they do.
  • Templates and examples are not advice. Built-in templates and sample strategies are generic starting points for learning. They are not tailored to you and not a recommendation to trade. Any performance ranking or “verified” label only describes how something scored on specific data.
  • Test before real money. The Platform is built so you can backtest and paper-trade first. We strongly encourage you to do so and to start small. You confirm the algorithm-deployment risk notice before an algorithm goes live.
  • No selling to others through AKQX. The Platform is not a venue for selling or distributing strategies, signals or tips to other people. If you charge others for advice, recommendations or signals, you may need your own SEBI registration or other approval. That is your responsibility, not ours.
  • If this ever changes. If we ever add a way to share or sell strategies, we will first update these Terms and the Refund Policy and only offer it in a form the law allows.

15. Acceptable use

You agree not to, and not to help anyone else to:

  • break any law, regulation or exchange or broker rule, or use the Platform for money laundering, terrorist financing, fraud, market manipulation, wash trading, spoofing, layering or insider trading;
  • access an account, broker connection or data that is not yours, or share, sell or rent your access;
  • probe or test the Platform's security, bypass authentication, rate limits or plan limits, or introduce malware;
  • scrape, crawl, bulk-download or systematically copy data, charts, rankings or content;
  • reverse-engineer, decompile or copy the Platform's software or models, except where the law does not allow us to restrict this;
  • overload or interfere with the Platform, our hosting, or your broker's or exchange's systems;
  • upload or share content that is unlawful, defamatory, obscene, infringing, misleading, or that impersonates anyone;
  • present Platform output as investment advice, or promote returns from the Platform to others in a misleading way or in breach of securities law.

We may remove content, restrict features, or suspend or end access if we reasonably believe you broke this section or the law, and we may report suspected unlawful activity to the authorities.

16. Intellectual property and your content

The Platform, including its software, design, logos, charts, indicators, models, detection logic, strategy templates and documentation, belongs to AKQX or its licensors and is protected by law. Subject to these Terms, we give you a limited, personal, revocable, non-exclusive, non-transferable licence to use the Platform for your own trading and research.

You keep ownership of what you create (for example layouts, drawings, alert rules and strategy settings). You give us a worldwide, royalty-free licence to host, process and display that content only to run and improve the services for you. Feedback you send may be used by us freely.

17. Third-party services

The Platform depends on and may link to services we do not control: brokers and exchanges you connect, data providers, e-mail and SMS providers, Google sign-in, Telegram, payment gateways and hosting providers. Their availability, accuracy and terms are their own, and we are not responsible for them or for sites we link to.

18. Availability and changes

We aim for reliable service but do not promise uninterrupted, error-free or secure operation. The Platform may be unavailable for maintenance, upgrades, data-feed problems, cyber-attacks, third-party failures or events beyond our reasonable control (including natural events, power or network failure, government action, exchange halts and regulatory change). We may add, change, limit or discontinue any feature, market or integration, including to comply with law, and will try to give reasonable notice of material changes.

Do not depend on the Platform alone. Keep the ability to manage or close positions directly with your broker or exchange.

19. Disclaimer of warranties

To the fullest extent the law permits, the Platform is provided “as is” and “as available”. We give no warranty, express or implied, including of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness or non-infringement, and none that any strategy, analytic, signal or backtest will be profitable, correct or error-free.

20. Limitation of liability

To the fullest extent the law permits:

  • AKQX and the people who work with it are not liable for any trading loss, loss of profit or opportunity, loss of data, or any indirect, incidental, special, consequential or punitive loss, arising from the Platform, even if we were told it was possible. This includes losses from market movement, leverage, slippage, order delay or rejection, broker or exchange failure, data errors, software bugs, strategy behaviour, missed alerts, unauthorised access caused by your own credentials, or third-party acts.
  • Our total liability to you for all claims connected with the Platform in any twelve months is limited to the greater of (a) the fees you paid us in the twelve months before the event and (b) Indian Rupees one thousand (₹1,000).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including for fraud, wilful misconduct, or rights you have as a consumer under the Consumer Protection Act, 2019.

21. Indemnity

To the extent the law permits, you agree to defend and compensate AKQX against claims, losses, penalties and reasonable legal costs arising from your breach of these Terms or the law, your trading, strategies or content, or a dispute between you and a broker, exchange or other third party.

22. Suspension and termination

  • By you. You may stop using the Platform and ask us to close your account at any time by e-mailing founder@akqxquantum.tech. Also revoke your API keys at your broker or exchange.
  • By us. We may suspend, restrict or end your access, with or without notice, if you breach these Terms or the law, if a regulator or law requires it, if we suspect fraud, abuse or a security risk, if the account is inactive, or if we discontinue the service.
  • Open positions. Suspension, termination or deletion of your account does not close, hedge or manage any position or order already open at your broker or exchange. Those remain your responsibility, so close or manage them directly with your broker before ending your account.
  • What survives. Sections that by nature continue (including disclaimers, liability, indemnity, intellectual property, governing law and accrued rights) survive. Your data is handled after closure as the Privacy Policy describes.

23. Changes to these Terms

We may update these Terms, for example for new features, paid plans, incorporation or changes in law. We will change the “last updated” date and, for material changes, give reasonable notice (in-app or by e-mail) before they take effect. If you keep using the Platform after the effective date you accept the update. If you do not agree, stop using the Platform and close your account.

24. Governing law and disputes

  1. Governing law. These Terms are governed by the laws of India.
  2. Talk to us first. Before any formal proceeding, send us a written description of the dispute (see “Grievance redressal”) and allow 30 days to try to resolve it.
  3. Arbitration. A dispute not resolved that way is finally settled by arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed by mutual agreement (failing which as the Act provides). The seat and venue are coming soon, the language is English, and the award is binding.
  4. Courts. Subject to the above, the courts at coming soon, India have exclusive jurisdiction, including for interim relief.
  5. Your consumer rights. Nothing here removes any right you have under the Consumer Protection Act, 2019, including to approach a competent consumer commission.

25. Grievance redressal and contact

In line with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Consumer Protection (E-Commerce) Rules, 2020 and the Digital Personal Data Protection Act, 2023, you can raise a complaint about the Platform, content on it, a paid service, or how your personal data is handled with our Grievance Officer:

For consumer complaints about paid services we also meet the e-commerce timelines (acknowledgement within 48 hours, resolution within one month). Requests about your personal data are answered as set out in the Privacy Policy.

26. General

  • Entire agreement. These Terms, with the Privacy Policy, Refund Policy and Disclaimer, are the whole agreement about the Platform and replace earlier understandings.
  • Severability and waiver. If a provision is unenforceable the rest stays in force; a delay in enforcing a right is not a waiver.
  • Assignment. You may not transfer your rights. We may assign ours, including to a company we incorporate or in a sale of the business, on notice to you.
  • Force majeure. Neither party is liable for a failure caused by events beyond its reasonable control. This does not excuse your own trading risk.
  • Notices. We may notify you on the Platform, in-app or by e-mail to your registered address. You can notify us at founder@akqxquantum.tech.
  • Language. These Terms are in English; any translation is for convenience only.
